Welcome to kasada.lk (“Kasada,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile pages, and any related services (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Site.

You must be 18 years or older to create an account or post ads on kasada.lk. By using the Site, you represent and warrant that you meet this age requirement and that all information you provide is truthful, accurate, and up to date. We reserve the right to suspend or terminate any account where we have reasonable grounds to believe the age requirement has not been met.

2.1 Accuracy of Data

You agree to provide accurate, current, and complete information during registration and to keep it updated at all times. Providing false or misleading information is a breach of these Terms and may result in account suspension.

2.2 Social Login (Google & Facebook)

If you sign in using Google or Facebook, you authorise us to access basic profile information from that account — specifically your name, email address, and profile picture, corresponding to the “email”, “profile”, and “openid” OAuth scopes. We do not request access to any data beyond these scopes.

You may revoke Kasada’s access to your Google account at any time by visiting myaccount.google.com/permissions. Revoking access will not automatically delete your Kasada account; please contact us at info@kasada.lk if you also wish to close your account.

2.3 Credentials & Account Security

You are solely responsible for maintaining the confidentiality of your password (or social-login credentials) and for all activity that occurs under your account. You agree to notify us immediately at admin@kasada.lk if you suspect unauthorized access to your account.

2.4 Account Misuse

We may suspend or terminate accounts that:

• Provide false or misleading information.

• Violate these Terms or any applicable law.

• Are used for spam, fraud, harassment, or any other abusive behavior.

• Remain inactive for an extended period (see our Privacy Policy for data retention details).

While using kasada.lk, you agree not to:

• Post content that is unlawful, defamatory, obscene, discriminatory, or otherwise objectionable.

• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

• Upload viruses, malware, ransomware, spyware, or any other harmful code.

• Attempt to gain unauthorized access to other accounts, our servers, or backend systems.

• Use automated scripts, bots, crawlers, or scraping tools without prior written permission from Kasada.

• Post the same ad multiple times or use deceptive techniques to inflate visibility.

• Collect or harvest personal data of other users without their explicit consent.

We reserve the right to remove any content or suspend any account that violates these rules, without prior notice and at our sole discretion.

4.1 Ownership

You retain ownership of the ads, photos, and other material (“Content”) you submit to kasada.lk.

4.2 License to Kasada

By submitting Content, you grant Kasada a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, distribute, and promote that Content for purposes of operating and promoting the Site. This licence ends when you delete the Content or close your account, subject to reasonable technical propagation delays.

4.3 Your Responsibility

You are solely responsible for the legality, accuracy, and appropriateness of your Content. You warrant that your Content does not infringe any third-party intellectual property rights, privacy rights, or applicable laws.

4.4 Content Removal

We reserve the right to remove any Content that violates these Terms, applicable law, or that we deem harmful to the community, without prior notice.

5.1 Payment Processing

Payments are processed securely by Stripe and PayPal. We never store your full credit card or bank account details on our servers. By making a payment, you also agree to the relevant payment provider’s terms of service.

5.2 Package Duration

Each advertising package has a defined duration. Once a package expires, the associated ad may be unpublished or marked as “expired.” Package durations are stated at the time of purchase and are non-extendable unless a renewal option is explicitly offered.

5.3 Refunds

Packages are non-refundable once the ad is published, except where required by applicable law. If you believe you were charged in error, you must contact us at info@kasada.lk within 7 days of the transaction date with supporting details. We will investigate and respond within 14 business days.

5.4 Taxes

Prices displayed on the Site are inclusive of applicable taxes unless otherwise stated. You are responsible for any additional taxes or duties applicable in your jurisdiction.

We use third-party tools to operate, analyze, and monetize the Site, including:

• Google Analytics – website usage analysis.

• Meta Pixel – user interaction tracking and marketing.

• Microsoft Clarity – session recordings and usability analysis.

• Google AdSense – display of relevant advertisements.

• Google reCAPTCHA – spam and bot prevention.

• Stripe and PayPal – payment processing.

Use of the Site implies acceptance of those services’ own terms and privacy practices. Ads displayed via Google AdSense are provided by Google; we do not endorse specific advertised products or services. Links to external sites are provided for convenience only; Kasada is not responsible for their content, accuracy, or availability.

7.1 Kasada Content

All text, graphics, logos, icons, and code created by or for Kasada are our intellectual property or that of our licensors. You may not copy, modify, distribute, sell, or lease any part of our materials without our prior written permission.

7.2 Trademarks

“Kasada.lk” and related marks are trademarks of Kasada.lk (Pvt) Ltd. All other trademarks, product names, and company names or logos mentioned on the Site are the property of their respective owners.

7.3 Feedback

If you submit suggestions, ideas, or feedback about the Site (“Feedback”), you grant Kasada an irrevocable, royalty-free licence to use and incorporate that Feedback without any obligation to you.

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using the Site, you confirm that you have read and understood those policies.

We comply with the applicable data protection laws of Sri Lanka. Where we process data of users in the European Economic Area, we do so in accordance with the General Data Protection Regulation (GDPR) to the extent applicable.

9.1 By You

You may close your account at any time via your profile settings or by emailing us at info@kasada.lk. Upon closure, your active ads will be unpublished and your personal data will be handled in accordance with our Privacy Policy.

9.2 By Us

We may suspend or terminate your account (with or without notice) if you breach these Terms, if we are required to do so by law, or if we reasonably suspect fraudulent or harmful activity.

9.3 Effect of Termination

Sections that by their nature should survive termination — including licenses granted, intellectual property rights, disclaimers, and limitations of liability — will continue to apply after termination.

10.1 “As Is” Service

The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.

10.2 No Consequential Liability

To the fullest extent permitted by applicable law, Kasada and its directors, employees, and partners will not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your use of (or inability to use) the Site, including loss of data, revenue, or profits.

10.3 Cap on Direct Damages

If Kasada is found liable for direct damages, our aggregate liability shall not exceed the total fees you paid to us in the 12 months immediately preceding the claim.

You agree to defend, indemnify, and hold harmless Kasada and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your access to or use of the Site.

• Your Content or any material you post or submit.

• Your breach of these Terms or any applicable law or regulation.

• Your infringement of any third-party right, including intellectual property or privacy rights.

These Terms are governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of the Site shall be submitted to the exclusive jurisdiction of the courts of Sri Lanka.

Before filing any formal legal action, you agree to attempt an informal resolution by emailing us a concise written description of your dispute at info@kasada.lk. We will aim to resolve it within 30 days of receiving your notice. If the dispute is not resolved within that period, either party may pursue formal legal remedies.

We may update these Terms from time to time to reflect changes in our services, business practices, or applicable legal requirements. If we make material changes, we will post the revised version on the Site and update the “Last updated” date above. We will also, where practical, notify you by email or via an in-site notification.

Your continued use of the Site after the revised Terms are posted constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Site and may close your account.

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Kasada regarding your use of the Site and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.

14.5 Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from causes beyond our reasonable control, including natural disasters, acts of government, power outages, or internet disruptions.
